General Terms and Conditions

1. Scope of application
The present General Terms and Conditions (GTC) apply to the online shop www.vasanta.ch, which is operated and maintained by Traumgut Brands AG, in Cham ZG, Switzerland (online shop), and thus for orders placed and purchase contracts concluded via the online shop.
The operator or the online shop reserves the right to change the GTC at any time. The version of the GTC valid at the time of the order is decisive, which, however, cannot be unilaterally changed for a completed order.
2. Offer
The offer is aimed at customers residing in Switzerland or Liechtenstein. Deliveries are only made to addresses in Switzerland or in Liechtenstein.
The offer is valid as long as it is visible in the online shop and/or while stocks last. Price and assortment changes are possible at any time. The images shown in advertisements, brochures, in the online shop etc. serve solely for illustration and are non-binding.
3. Order
The presentation of goods in the online shop is not a legally binding offer, but a non-binding online catalogue or a non-binding invitation to the customer to order the goods in the online shop.
An order is considered an offer by the customer to the online shop to conclude a contract via the online shop.
After transmission of the order, the customer automatically receives an order confirmation, which documents that the order has been received by the online shop. After receiving this confirmation, the customer can no longer change the order and is bound to it.
The online shop is free to reject orders in whole or in part without giving reasons. In this case, the customer will be informed, and any payments already made will be refunded. Further claims are excluded. Temporarily unavailable goods cannot be pre-ordered or reserved.
4. Conclusion of contract
A purchase contract is only concluded with the dispatch of the ordered goods. As soon as the order is shipped, the customer will be informed by email.
The customer will then be continuously informed about the shipping status or progress via email.
5. Prices
The prices in the online shop are in Swiss francs (CHF), including value-added tax (VAT) and, where applicable, including advance recycling fee (vRG).
The decisive price is the one in the online shop at the time of the order or according to the order confirmation, which the customer receives by email upon completion and payment of the order.
Not included in the price are chargeable additional services such as shipping or transport costs, which are listed separately in the shopping cart, on the advance invoice or in the order confirmation. For orders of CHF 200 or more, shipping or transport of the ordered goods is free of charge.
Returns or costs in connection with returns are borne by the customer.
6. Payments
Orders via the online shop or the ordered goods must be paid for in advance by the customer using the payment methods offered or available in the online shop.
Payments must be made in the currency CHF. Delivery or shipping of goods on account is excluded.
When paying with electronic means of payment such as credit or debit cards, the amount will be debited before or at the latest with the dispatch of the goods.
In any case, ordered goods are not reserved until payment is received and may become unavailable in the meantime.
Vouchers can be ordered in the online shop and redeemed within the expiry date according to the voucher and/or online shop. Vouchers must be redeemed directly when ordering via the online shop. Subsequent redemption of the voucher is no longer possible and is excluded.
7. Retention of title, benefits and risks
The ordered goods remain the property of the online shop until they are fully paid for or until the goods are shipped.
From the moment of dispatch, the benefits and risks as well as the delivery, shipping or transport risk pass to the buyer.
8. Delivery
The delivery address must be in Switzerland or Liechtenstein and must be easily reachable and accessible for Swiss Post and/or by delivery vehicle. Delivery or shipping generally includes delivery to the curb.
In no case are any additional services such as unpacking, placement and/or assembly of the goods, return of packaging materials, disposal etc. included. Delivery or shipping costs are shown separately in the shopping cart, on the advance invoice or in the order confirmation, in addition to the price of the ordered goods.
For delivery addresses without access roads or with difficult accessibility, delivery is made to the nearest access point or train station. If the customer still wishes delivery to their address, the customer must bear the additional costs and pay them in advance. If additional costs arise during delivery or shipping, the customer must bear them.
If goods are delivered with obvious damage to the packaging or content, the customer must immediately complain to the transport service provider (e.g. carrier, post office) and refuse acceptance.
The customer must have a damage confirmation issued by the transport service provider. All such transport damages must also and simultaneously be reported to the online shop without delay.
If the customer does not accept the ordered goods, the online shop may charge the customer for any resulting costs and/or expenses. Furthermore, the online shop reserves the right to withdraw from the purchase contract in this case, without having to refund the purchase price or to offset all incurred costs and/or expenses against the purchase price.
9. Delivery date
A provisional delivery date is communicated with the order confirmation via email to the customer. This, the delivery times stated in the online shop and the shipment tracking via email are non-binding and are only intended as guidance for the customer.
In the event of (partial) impossibility of delivery, the corresponding order will be cancelled by the online shop, the customer informed and any payments already made, subject to any costs and/or expenses charged to the customer by the online shop, refunded.
Further claims by the customer due to delivery delays or (partial) delivery impossibility or delivery failure are excluded.
10. Defective, faulty goods and return rights
A right of return only exists for defective or faulty goods and provided the provisions of these GTC are complied with by the customer. An exchange of goods due to dislike, wrong measurements, dimensions etc. is not possible.
It is the responsibility of the customer to check the ordered goods immediately upon receipt. A return of only the defective or faulty goods is possible within 5 calendar days after delivery. If the customer cannot prove delivery, e.g. cannot present a delivery or receipt confirmation, the 5-day period begins from dispatch of the order.
The goods must be returned in original packaging, undamaged, unused, clean, complete with any accessories.
The reported goods must always be returned with proof of purchase and, if a return slip was included in the delivery, necessarily with the completed return slip, and not to the online shop, but to the distribution center. For other returns, the processing center must be contacted in writing to organize the return or collection.

The costs for the return as well as for any reshipment are to be borne by the customer.
If the customer returns the goods in accordance with these provisions in original packaging, undamaged, unused, clean, complete with any accessories and proof of purchase, the payment already made will be refunded, subject to any costs and/or expenses charged to the customer by the online shop.
Returns of goods are not paid out in cash by the online shop but are generally credited or refunded to the payment method used for the customer’s order. The online shop may also issue the customer a voucher.
In addition, the statutory warranty rights apply. Any further guarantees and/or assurances from the online shop are excluded.
11. Privacy policy and data protection
The customer is hereby informed that the data collected during the order, i.e. the conclusion of the contract via use of the online shop, or disclosed by the customer for this purpose, will be collected, processed and used to fulfill the obligations of the purchase contract. The data necessary for service provision and contract fulfillment may also be passed on to contracted service partners (e.g. distribution center, logistics companies, service partners, debt collection agency), including to countries that may not have equivalent data protection.
The customer expressly agrees to this privacy policy and data usage, especially with the continued use of the online shop, demonstrably by placing further orders via the online shop.
12. Applicable law and place of jurisdiction
In the relationship between the online shop and the customer, Swiss substantive law applies, namely the Code of Obligations (SR 220.0), excluding conflict-of-law rules and the Vienna Convention on Contracts for the International Sale of Goods.
The place of jurisdiction is the registered office of the operator of the online shop and thus exclusively the courts in Cham ZG, Switzerland.
